THE ROLE OF BANKS IN THE ECONOMY:AN IMPRESSIVE COMPILATION OF KEY RESEARCH OF SPECIAL INTEREST TO THE LEGAL PROFESSIONAn appreciation by Elizabeth Robson Taylor of Richmond Green Chambers and Phillip Taylor MBE, Head of Chambers, Reviews Editor, “The Barrister”, and MediatorNow in a new third edition from the Oxford University Press, ‘The Oxford Handbook of Banking’, has become the definitive — and very accessible — work of reference for anyone connected professionally with banking, which in the UK, contributes mightily not only to a large chunk of the UK economy, but to the economic wellbeing of legions of other economies worldwide. With these thoughts in mind, this is not merely a handbook for bankers. Those lawyers who advise financial services clients will almost certainly view it as a source of insight and information into the intricacies and complexities of this key industry. Note, for example, that in the preface, editors Allen N Berger, Philip Molyneux, and John O. S. Wilson, point out that, for any number of reasons, (many of them linked to the disasters of 2007-2008) —‘banks now have to spend more on regulatory compliance.’They also comment in the book’s introductory chapter that following ‘the worst financial crisis faced since the Great Depression,’ banks have ‘significantly de-risked and now hold more liquidity and capital than in the past.’ The point is also made that ‘tougher capital rules’ for large banks, agreed at the end of 2017, are due for implementation in 2022. Lawyers take note.Over its more than 1,200 pages and thirty-eight chapters, the book provides a formidable repository of the expertise of at least eighty contributors, described as ‘a who’s who of the top researchers in the field.’One of the book’s most fascinating chapters is the one on risk management in banking. As contributors, Linda Allen and Anthony Saunders explain, financial institutions are risk intermediaries. Of necessity, they maintain an ‘inventory of risk’ which must be measured accurately in order to ensure ‘that risk exposure does not threaten the bank’s insolvency’. Reference is made here to the mispricing of risk, which in the case of subprime mortgage securities, emerged as a key factor in precipitating the 2007 credit crisis. In answer to the question of “why do we care?”, the writers refer to the ‘economic wreckage’ generated by said credit crisis and the clear evidence that “systemically important” banks ‘can set off a chain reaction of financial contagion when they become distressed.’ Such is the impact of the banking industry in the wider economy.Carefully researched and clearly written, this Handbook has become regarded as well-nigh indispensable in enhancing an understanding of banking and the banking industry among a wide readership, which includes academics, legal practitioners and indeed anyone involved professionally with the financial sector. The date of publication of this hardback third edition is cited as at 7th November 2019.
